Article 1: General provisions
The e-commerce website of bv De Clippel, a private limited company with registered office at Zwarte Zustersstraat 4 - 9300 Aalst, BTW BE 0424 005 509, RPR Dendermonde, (hereinafter referred to as 'bvba De Clippel') offers its customers the opportunity to purchase the products from its online store to buy.
These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). Placing an order via the Cocinella web shop implies that the Customer has consulted these Conditions and expressly accepts the applicability of these Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted by Cocinella in advance, in writing.
Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other duties or taxes required by the Customer.
If delivery costs are charged, this will be stated separately.
The price statement refers exclusively to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on Cocinella. Cocinella is only bound to an obligation of means with regard to the correctness and completeness of the information provided. Cocinella is in no way liable in the event of material errors, typesetting or printing errors.
If the Customer has specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service in advance.
The offer is always valid while stocks last and can be adjusted or withdrawn by Cocinella at any time. Cocinella cannot be held liable for the unavailability of a product.
Article 4: Online purchases
The Customer selects the items and places them in the shopping cart.
• When the order is complete, the Customer goes to the shopping cart where he gets an overview of the order.
• On the next page, the Customer can register or log in if the Customer is already known. The Customer can also adjust his delivery address here.
The Customer has the choice between the following payment methods:
• by credit card
• via bank card (Belgium)
• via Paypal (Netherlands)
The products offered through this e-commerce website constitute an offer subject to the condition of acceptance by Cocinella.
Cocinella is entitled to refuse an order (in writing) due to a serious shortcoming of the Customer with regard to the order or any other order or agreement in which the Customer is involved.
Article 5: Delivery and execution of the agreement
We strive to deliver all purchased items as quickly as possible, within 1 - 3 weeks. Some items have a longer delivery time. This is always stated with the article. The delivery time of an order is determined by the item with the longest delivery time.
Articles ordered through this web shop are delivered by appointment in Belgium, the Netherlands, France, Germany and others........ by Cocinella or BOPITA.
You can also choose to pick up the purchased items for free after making an appointment in our store. (Stationsstraat 21 - 9300 Aalst)
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to Cocinella.
The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Cocinella .
Article 6: Retention of title
The delivered items remain the exclusive property of Cocinella until full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of Cocinella 's retention of title, eg to anyone who would seize the items not yet fully paid for.

Without prejudice to the exercise of other rights available to Cocinella, in the event of non-payment or late payment from the date of default, by operation of law and without notice, the Customer owes an interest of 10% per year on the unpaid amount. In addition, by operation of law and without notice, the Customer owes a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, Cocinella reserves the right to take back items that have not been paid (in full).

These Terms and Conditions are supplemented by other terms and conditions explicitly referred to, and the Cocinella general terms and conditions of sale. In the event of any contradiction, these Terms and Conditions shall prevail.
Cocinella may change these Terms at any time without further notice. Any purchase after the change constitutes an acceptance by the Customer of these new Terms.
Article 15: Evidence
The Customer accepts that electronic communications and backups can serve as evidence.
Article 16: Applicable law - Competent court
Belgian law is applicable, with the exception of the provisions of private international law on applicable law and of the Rome I Regulation on international sales contracts relating to movable property. In the event of any disputes, only the courts in Dendermonde are competent.
